27.5 AL – Recordkeeping

Lesson 27: Alabama Brokerage Regulation
Topic 27.5 — Recordkeeping

Recordkeeping is part of compliance. In Alabama, brokers should retain key transaction documents in their files—especially
estimated and actual closing statements. Good recordkeeping protects the consumer, supports accurate accounting,
and helps a brokerage respond if a question, audit, or complaint ever comes up.

Closing Statement Retention (Who Keeps What)

  • Both the estimated closing statement and the actual closing statement must be retained in the broker’s files.
  • The buyer’s agent should retain the estimated and actual closing statements signed by the buyer in the qualifying broker’s files.
  • The seller’s agent should retain the estimated and actual closing statements signed by the seller.
  • Neither licensee is required to retain statements signed by both the buyer and the seller.
  • Cooperating brokers are not required to maintain both the buyer’s statement and the seller’s statement.

How Long Should Records Be Kept?

Alabama law does not specify an exact retention time for closing statements. However, as with other real estate transaction records,
the recommended best practice is to retain them for at least 3 years.

Practical takeaway: Keep your file system consistent and complete. If a question comes up later, good records help you prove what was provided, when it was provided, and who acknowledged receipt.
