26.1 AL – Licensing Requirements
Alabama license law spells out which real estate activities require a license and what it means to act “for compensation.”
In Alabama, if you engage in the practice of real estate for compensation, you generally must be licensed as a broker or salesperson—
and your license must be on active status.
When a License Is Required
Alabama law requires any person or business entity (sole proprietorship, partnership, corporation, branch office,
or other legal business organization) that engages in the practice of real estate for compensation to be licensed as a real estate
broker or salesperson.
Key exam reminder: The license must be on active status to perform activities that require a license.
What Counts as “Compensation”
- Compensation includes fees, commissions, or other valuable consideration received from another person.
- Doing a licensed activity with the intention or expectation of receiving compensation is treated the same as actually receiving it
for purposes of deciding whether a license is required.
Activities That Require a License (If Done for Compensation)
“Engaging in the practice of real estate” includes the following activities involving real estate located in Alabama:
- Offering or selling, exchanging, purchasing, renting, or leasing real estate
- Negotiating the listing, sale, exchange, purchase, rental, or leasing of real estate
- Listing for sale, rental, lease, exchange, or trade any real estate
- Auctioning any real estate
- Optioning real estate
- Locating for purchase, rent, or lease any real estate
